Terms and Conditions

By entering the HotelClub Promotion (the "Promotion"), you are agreeing to the following terms and conditions:

1. STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open to all residents of New Zealand. If the Main Prize Winner is under the age of 21 years, the Prize will be awarded to the Main Prize Winner's parent or guardian.

2.2 Directors, management, employees and their immediate families of the Promoter, the Sponsor and their associated agencies are not eligible to enter this Promotion.

3. HOW TO ENTER

3.1 The Promotion commences at 12 pm NZDT on May 6 2008 and concludes at 12 pm NZDT Monday 12 May 2008.

3.2 Entries are to include your name, full address, daytime contact number and email address and then tell us in 25 words or less why your mum deserves a holiday.

3.3 Entrants may enter the Promotion as many times as they like but may not use "scripting" for multiple entries (which will be deemed invalid).

3.4 Entries must be received by Monday 12 May 2008 at 10am NZDT.

3.5 The entry must be:
(a) the original independent creation of the entrant; and
(b) free from any claims, including copyright or trademark claims, by other parties.

3.6 Entry details remain the property of the Promoter and will not be returned to the entrant. The Winners agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and the Winners will not be entitled to any fee for such use.

4. PRIZES

4.1 There will be five (5) winners (the "Main Prize Winners.") Prize details are as stated below.

4.2 Each winner will receive a voucher for NZ$2,000, to be spent within the year, on accommodation for two people in any of the HotelClub hotels in New Zealand.

Total retail prize value is NZD$10,000.

The prize must be

• The prize must be booked via HotelClub using the voucher - by choosing a hotel located at http://www.hotelclub.co.nz/
• The prize may not be used in conjunction with any other offers
• The prize may only be used to book hotel stays which are to take place prior to 24th December 2008.

4.3 Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the Prize is taken.

4.4 The Main Prize Winners and their companions will be required to bear the cost and make their own travel arrangements within New Zealand to take up the Prize.

4.5 The Main Prize Winners and their companions are responsible for all other expenses incurred in participation of the Prize including, but not limited to, transport to the selected hotel. Any fees incurred in any changes to the travel arrangements or additional expenses are not included in the Prize. Travel insurance is the responsibility of the Main Prize Winners and their companions. HotelClub and Yahoo!Xtra Pty Ltd are not liable for any costs incurred if any Main Prize Winner or their companion travels without insurance.

4.6 In entering this Promotion, the Main Prize Winners agree, and will procure their companions agreement, to participate and co-operate as required in all editorial activities relating to the Promotion, including but not limited to being interviewed and photographed. The Main Prize Winners agree, and will procure that their companions agree, to grant the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the Main Prize Winners (and their companions) will not be entitled to any fee for such use.

4.7 Each Main Prize Winner agrees that he or she will not (and will ensure that his or her companion does not) sell or otherwise provide their story and/or photographs to any media or other organisation.

4.8 Prizes cannot be transferred or redeemed for cash. The Main Prize Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.

5. HOW TO WIN

5.1 All entries will be judged at Yahoo!Xtra at Level 2, 168 Parnell Road, Parnell, Auckland on Thursday 21 February 2008 at 2pm. The Main Prize Winners will be the five (5) entrants whose entries are judged by a panel of judges appointed by the Promoter to be the most creative from all entries received. If any Main Prize Winner is under the age of 21 years, the Prize will be awarded to the Main Prize Winner's parent or guardian.

5.2 The Promotion is a game of skill and chance plays no part in determining the winners.

5.3 Main Prize Winners will be notified by Yahoo!Xtra via a phone call on the day of the judging, and a letter advising the Main Prize Winners of the Prize will also be posted.

5.4 The judges' decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result.

5.5 It is a condition of accepting the Prize that the Main Prize Winners (and their companions) must comply with all the conditions of use of the Prize and Prize supplier's requirements.

5.6 It is a condition of accepting the Prize that the Main Prize Winners and their companions may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

6. NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions.

6.2 The Promoter, the Sponsor and their associated agencies and companies take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.3 The Promoter, the Sponsor and their associated agencies and companies are not liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

a) during the judging;

b) whilst undertaking any travel won on or connected with their entry into the Promotion;

c) in the participation in any Prize;

d) as a consequence of late, lost or misdirected mail; or

e) due to the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person.

6.4 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.

6.5 If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion

7. PROMOTER'S DETAILS AND PRIVACY

7.1 The Promoter is Yahoo!Xtra New Zealand Limited of Level 2, 168 Parnell Road, Parnell, Auckland.

7.2 The Sponsor is HotelClub, Level 28, 680 George Street, Sydney NSW 2000, Australia.

7.3 By entering this Promotion you agree to Yahoo!Xtra's use of your personal information as described on Yahoo!Xtra's Privacy Policy http://privacy.yahoo.com/privacy/au. All entries become the property of Yahoo!Xtra and your name may be included on a database. By entering this Promotion you consent to Yahoo!Xtra including your name in future mail, newsletter, email, SMS or other campaigns.
